These Terms and Conditions ("Terms") govern your access to and use of the CalBox platform operated by Nanomite Technologies Private Limited ("Company", "we", "us", or "our"), accessible at calbox.in and through the CalBox mobile application. By registering for or using the Service, you agree to be bound by these Terms.
1. Definitions
- "Service" refers to the CalBox web platform and mobile application
- "Account" refers to the registered company account on CalBox
- "Admin" refers to the company administrator who manages the Account
- "User" refers to any individual granted access to the Service under an Account (admins, managers, callers)
- "Caller" refers to a user who makes calls through the CalBox dialer
- "Campaign" refers to a set of phone numbers uploaded for calling purposes
2. Account Registration
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- Each company may register only one Account; multiple accounts for the same entity are not permitted
- You must be at least 18 years old and have the legal authority to bind your organisation to these Terms
- We reserve the right to suspend or terminate accounts that provide false or misleading information
3. Free Demo & Subscription
- New accounts receive a free demo period (currently 5 days with 5 callers) to evaluate the Service
- After the demo period, continued use requires an active paid subscription
- Billing is based on the number of active callers at the applicable rate (currently ₹10 per caller per day)
- We reserve the right to modify pricing with 30 days' advance notice via email
- Unused balance is non-transferable between accounts
4. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Use the Service for spam calling, harassment, or any illegal telemarketing activity
- Upload campaign data that violates the Telecom Regulatory Authority of India (TRAI) regulations, including Do Not Disturb (DND) numbers
- Attempt to bypass, disable, or interfere with any security features of the Service
- Use the Service to collect, store, or transmit sensitive personal data in violation of applicable laws
- Reverse engineer, decompile, or disassemble any part of the Service
- Share your account credentials with unauthorised third parties
- Use automated bots, scrapers, or other tools to access the Service without permission
5. Data Ownership
- Your Data: You retain full ownership of all data you upload or generate through the Service, including campaign data, call records, leads, and company information
- Our Platform: We retain all rights to the CalBox platform, including its design, code, features, and branding
- Data Export: You may request an export of your data at any time by contacting support
- Licence Grant: By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service to you
6. Service Availability
- We strive to maintain 99.9% uptime but do not guarantee uninterrupted access
- Scheduled maintenance will be communicated in advance when possible
- We are not liable for downtime caused by factors beyond our control, including internet outages, server failures, or force majeure events
- Maintenance mode may be enabled during critical updates, during which API access may return 503 responses
7. Payment Terms
- All payments are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
- Payments are processed through secure third-party payment gateways
- Prepaid balance is deducted daily based on active caller count
- Accounts with zero or negative balance may be suspended until topped up
- We do not store credit card or banking details on our servers
8. Account Suspension & Termination
We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use policy
- Your account has been inactive for more than 180 days
- You fail to maintain a positive balance for more than 30 days after the demo period
- We receive a valid legal or regulatory request to do so
You may terminate your account at any time by contacting us at mail@calbox.in. Upon termination, your data will be handled as described in our Privacy Policy.
9. Intellectual Property
The CalBox name, logo, and all associated branding, software, and content are the intellectual property of Nanomite Technologies Private Limited. You may not use, copy, modify, or distribute our intellectual property without prior written consent.
10. Limitation of Liability
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim shall not exceed the amount paid by you to us in the 3 months preceding the claim
- We are not responsible for the accuracy, legality, or appropriateness of campaign data uploaded by users
11. Indemnification
You agree to indemnify and hold harmless Nanomite Technologies Private Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
12. TRAI Compliance
You acknowledge that you are solely responsible for ensuring compliance with all TRAI regulations, including but not limited to the Telecom Commercial Communications Customer Preference Regulations (TCCCPR). CalBox is a tool for managing call operations and does not verify DND compliance on your behalf.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the platform at least 15 days before they take effect. Continued use of the Service after changes constitutes acceptance.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Nellore, Andhra Pradesh. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.
